You (or the User) have been granted access to the DATIZY Platform because the entity for which you work or an entity of the same group (the Company) has signed a Contract with DATIZY granting it access to the DATIZT Platform.
These terms and conditions govern access to and use of the Platform by Users.
Access and permissions
Access to the Platform
To access the Platform, You have chosen Identifiers (a username which must be an individual non-shared email address, and a password) or have been granted Identifiers enabling You to access the interface reserved for the Company (Client Area). To ensure the security of the Platform, You must: :
- Keep all Identifiers strictly confidential and immediately notify the Company or DATIZY of any unauthorised use of Identifiers or the Client Area, as well as any other known or suspected breach of security.
- Inform the Company or DATIZY immediately if you believe that any unauthorised activity has taken place on the Client Area.
Permission levels
The Company assigns each User an access Permission Level:
- Super Administrator: creates sites, zones and equipment; creates teams; accesses the dashboard; creates forms; edits QR codes; configures tasks.
- Administrator: accesses the dashboard, manages anomalies and data.
- Operational: scans QR codes, fills in forms, manages operational tasks.
The User must at all times respect the Permission Level granted to him and must not under any circumstances attempt to circumvent the access restrictions in place. DATIZY cannot decide at its discretion to grant You more rights. If You need access to a higher Permission Level, please contact a person in the Company who has access to such a level or a Super Administrator.
Restrictions on use
Use of the Platform must comply with all applicable laws and regulations.
You are not authorised to carry out the following actions:
- use the Platform for purposes other than those of the Company (i.e. recording data relating to maintenance operations on the Company’s sites).
- provide access to the Platform to a person not authorised by the Company.
- reproduce, modify, disassemble or distribute, in whole or in part, the Platform.
- attempt to circumvent, remove or disable any protection mechanism of the Platform or its components, including any mechanism used to restrict or control the operation of the Platform, or to derive the source code or underlying ideas, algorithms, structures or organizations of the Platform.
- correct errors encountered on the Platform yourself (if You find an error, You must contact DATIZY immediately);
- file patents or other applications for the protection of intellectual property relating to the Platform or its components;
- set up a service competing with the Platform or DATIZY’s activities.
Data and content regulations
Personal data
Your personal data as a User is processed by DATIZY. Please consult DATIZY’s Privacy Policy for more information.
User-Generated Content (UGC)
The Platform allows Users to upload and share information and content, including data about themselves. You guarantee that any datam image, text or information that You make available or create when using the Platform (UGC) complies with these Terms of Use and all applicable laws and regulations.
The User must not :
- give false or misleading information about themselves or a third party;
- promote or engage in any conduct that is unlawful or illegal or results in damage to any person or property;
- submit UGC containing nudity or violence or content that is threatening, obscene or offensive;
- infringe copyright or trademark laws in any other way, or generally violate the rights of third parties;
- submit UGC about another person without that person’s permission;
- include sensitive personal data such as data relating to health, political or religious opinions, sexual preferences, etc in the UGC.
Users authorise DATIZY to use the UGC in all possible ways. DATIZY shall use any UGC in accordance with the Agreement and the DATIZY Privacy Policy.
Legal and compliance terms
Intellectual property
DATIZY and its licensors own all right, title and interest, including all intellectual and industrial property rights, in and to the Platform and the underlying technology, associated mobile applications and any user interface.
Your right to access the Platform does not give you or the Company any ownership rights in the Platform.
Limitation of warranty
The Platform will be provided in accordance with general industry standards applicable to that technology and the Platform’s online help documentation in normal circumstances.
The Platform is provided “as is” and all other conditions, representations and warranties, express or implied, including, but not limited to, warranties of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement, are disclaimed to the fullest extent permitted by applicable law.
There is no warranty that the Platform will be uninterrupted or error-free, nor any warranty as to the results that may be obtained from the use of the Platform.
Absence of liability
DATIZY acts as a subcontractor of the Company. For any claim or question relating to a damage resulting from the execution of the Contract between DATIZY and the Company, or from the use of the Platform, please contact the Company.
Confidentiality
All commercial and technical information transmitted to you via the Platform, whether User data or technical data relating to the Platform, must remain confidential.
As a User, you undertake to take all precautions reasonably necessary to preserve the confidentiality of such information.
Termination of DATIZY licence
In the event of termination of the licence granted to the Company on the Platform, for whatever reason, your rights as a User to access the Platform will cease.
Non-compliance with the Terms of Use
Failure to comply with these Terms of use may result in DATIZY taking any or all of the following actions (with or without notice):
- immediate, temporary or permanent deactivation of the Client Area;
- immediate, temporary or permanent deletion of any UGC;
- issue a warning to You or to the Company;
- legal action against You or the Company.
The actions described in this paragraph are not limited and DATIZY may take any other action we reasonably consider appropriate.
Modification des Conditions d’utilisation
DATIZY may modify the Terms of use at any time at its sole discretion. If we do so, we will inform you and provide you with the new Terms of use.
